The only place for teleworking should be the place of affectation of the assistant." (in Brussels)

MEPs meeting 09/03/2020

1. Delegation admin assistant - Dani - we made a mistake when submitting her documents and unintentionally cut her traineeship one month short. Therefore, we need to prolong it by one month at least - until the 10th of May. She is also applying for Miky’s admin assistant so hopefully until then it will be clear whether she will be hired or not.
2. Software developer Mattia - no progress so far on the italian paying agent situation. I would like to ask you to exceptionally approve to pay him one month of work from the GEA, because he was already working with Panda. Until I find a paying agent who is within acceptable price range, he will not continue working without his contract.
3. Transition - hiring two new Admin assistants (Marcel’s procurement closing today, Miky’s next week) - Petra taking care

Dotaz:
Pokud poslanec Evropského parlamentu uzavře individuální smlouvu s poskytovatelem služeb, které jsou vykonávány na základě živnostenského oprávnění, za jakých podmínek je možné zveřejnit výši odměny poskytovatele služeb?
Pokud má europoslanec uzavřenou pracovní smlouvu, kde vystupuje jako zaměstnavatel, za jakých podmínek je možné, aby zveřejnil výši platu zaměstnance?

V případě zveřejnění odměny /platu asistentů poslanců Evropského parlamentu (např. na webových stránce daného poslance či politické strany – způsob zveřejnění však nekonkretizujete) je pro tuto činnost nutno disponovat relevantním právním titulem dle čl. 6 odst. 1 nařízení Evropského parlamentu a Rady EU 2016/679o ochraně fyzických osob v souvislosti se zpracováním osobních údajů a o volném pohybu těchto údajů (dále jen „obecné nařízení o ochraně osobních údajů“).

V posuzovaném případě se relevantním právním titulem jeví souhlas dotčeného subjektu údajů (konkrétního asistenta či poskytovatele služeb) dle čl. 6 odst. 1 písm. a) obecného nařízení o ochraně osobních údajů či zpracování předmětných osobních údajů na základě splnění úkolu správce vykonávaného ve veřejném zájmu, tj. dle čl. 6 odst. 1 písm. e) obecného nařízení o ochraně osobních údajů.

V případě udělení souhlasu zaměstnance je však nutné, aby takovýto souhlas splňoval požadavky, uvedené v čl. 4 bod. 11 obecného nařízení o ochraně osobních údajů, především to, aby se jednalo o svobodný projev vůle daného zaměstnance.
Při rozhodování o možnosti aplikace právního titulu veřejného zájmu je nutné se zaměřit na posouzení toho, zdali se v daném případě jedná o činnost, kterou danému subjektu určil právní předpis či se jedná o postup za účelem informování veřejnosti o transparentním nakládání s veřejnými prostředky, nebo o činnost z rozhodnutí správce.

Ve všech případech však půjde o transparentnost v postupu unijních institucí, která je i podle tuzemských právních předpisů vázána též na použití veřejných prostředků. To znamená, že tu část platu/odměny osob, které jsou příjemci platu/odměny od poslance Evropského parlamentu, (tj. jedná se o finanční prostředky poskytované ze strany EU), je s poukazem na uvedenou zásadu transparentnosti možno poskytnout bez souhlasu dotčeného příjemce. Tento příjemce musí být vždy informován předem.

In all cases, however, there will be transparency in the procedure of the EU institutions, which is also bound by the use of public funds even under domestic law. This means that that part of the salary / remuneration of the person receiving the salary / remuneration from a Member of the European Parliament (ie the EU funding) can be provided without reference to the principle of transparency without the consent of the beneficiary concerned. This recipient must always be informed in advance.

Measures in response to the corona virus crisis severely restrict our freedom of going about our daily lives.
