Mikuláš včera poslal překlad tiskové zprávy o trestním stíhání kvůli sledujuserialy.cz. Před chvílí jsem jim poslal ještě tyhle doplňující informace:
PP-CZ took patronage over existing website sledujuserialy.cz in January 2013, aiming to achieve a similar precedent as in the Svensson case[1] and also to stop bullying of poor students by creating a bigger target that the copyright MAFIAA cannot ignore. The website sledujuserialy.cz was just a big database of embed links to unrelated external servers hosting the actual content. No video content was hosted directly on our servers or uploaded to external servers by PP-CZ members.
CJEU carefully avoided ruling on linking to copyright-infringing copies in the Svensson case so the precedent is still needed and now cannot be avoided anymore (unless MAFIAA gives up). If we lose this lawsuit, PP-CZ will most likely be dissolved by court. Czech law allows dissolving corporations as penalty for criminal offenses since 2014.
If you had to make certain that the target of your link does not infringe copyright, the Svensson precedent would be meaningless.
